We, Andrew Dolliver (IP No. 15230) of Ernst & Young LLP, Bedford House, 16 Bedford Street, Belfast BT2 7DT and Timothy Vance (IP No. 26710) and Charles Graham John King (IP No. 8985) both of Ernst & Young LLP, 12 Wellington Place, Leeds LS1 4AP were appointed as Joint Administrators of the Company on 23 September 2024.
Pursuant to the Order of the High Court of Justice in Northern Ireland, Chancery Division dated 26 May 2026, a scheme of distribution (“Scheme of Distribution”) was approved setting out how the Joint Administrators will deal with the distribution of monies held on trust by the Company in a project bank account at the time of its entry into administration (“PBA”).
To the extent that a supplier considers it may have outstanding balances with the Company and is entitled to a share of monies in the PBA, they should submit their PBA proof (and relevant supporting documentation) to the Joint Administrators as soon as possible but by no later than six months from the date of the order (“Bar Date”), unless they have already done so. For the avoidance of doubt the Bar Date is 28 November 2026.
The Joint Administrators (or any subsequently appointed liquidator) intend to declare and make a distribution from the PBA, as soon as possible after the Bar Date. The distribution will be the first and final distribution being declared.
Any client that submits their PBA proof after the Bar Date will not be entitled to any distribution from the PBA, but instead, the client will be deemed to have submitted a proof of debt in the administration (or subsequent liquidation) of the Company to the extent admitted by the Joint Administrators (or any subsequently appointed liquidators).
